While the Lopez Amendment provides some of the elements that weed out lower-level gambling cases, its protection of the First Amendment has been questioned. Despite this, the Commerce Clause seems to provide a bulwark against legislative power in the United States. Although attacks based on the Due Process Clause have failed to yield much success, the commercial nature of the gambling industry appears to satisfy the Commerce Clause.

While some state officials have questioned the use of the Internet to bring illegal gambling into their jurisdictions, others have been less receptive. This has led to a number of challenges to the effectiveness of the federal law.

Although the simplest and most obvious way to enact this statute was to prohibit the use of credit cards to pay for gambling, this hasn’t been the case.
